BAVARIA RENT Ltd., having all identification data specified on the backside of this agreement, hereafter named 'Bavaria Rent | BMW car rental/hire', and THE CUSTOMER, having all identification data specified on the backside of this agreement, hereafter named 'The customer'.

Article 1 Object of the agreement:
 The object of this agreement is the use (rental) of a car, property of Bavaria Rent | BMW car rental/hire, by the customer. By signing the present terms and conditions, the customer agrees to all the stipulations in the backside of this agreement. The basic price of the rental does not include any taxes or additional costs.

Article 2 General terms of rental:
The car will be rented under the specific terms and conditions. The customer is requested to carefully read this car rental agreement before signing it and hereby agreeing with it. Bavaria Rent | BMW car rental/hire reserves the right to refuse the rental of any car, without further explanations. The customer, renting a Bavaria Rent | BMW car rental/hire car, must meet all Bavaria Rent | BMW car rental/hire's qualifications, standards and requirements.

Article 3 Delivery and return:
The car is delivered to the customer in good overall conditions. Any complaints related to its condition have to be made immediately upon receiving the car and must be specified in the technical conditions certificate, which is recognized by the parties to be sufficient evidence for proving any further damage to the car. The customer agrees to return the car, property of Bavaria Rent | BMW car rental/hire in good condition. The customer will return the car with all documents, equipments and other accessories in good condition on the location and on the date specified in this agreement.
In case of damages to the rented vehicle, found after the return of the car and mentioned in an official document (mainly technical conditions certificate even if it is not signed by the customer - he forgets, he returns the car out of program hours, refuses to sign it), the customer agrees that he is responsible for these damages, and agrees to be charged with any amount necessary for covering the damages. The customer agrees to sign any document required by Bavaria Rent | BMW car rental/hire with regard to the payment of these subsequent damages. In case of a delay of more than 24 hours from the agreed time of return specified in this agreement, should the customer fail to notify Bavaria Rent | BMW car rental/hire by phone, fax or e-mail, Bavaria Rent | BMW car rental/hire reserves the right to call in the police for car theft or embezzlement.

Article 4 Conditions of use:
The customer agrees that the car, property of Bavaria Rent | BMW car rental/hire, shall not be operated or driven under the following circumstances: In violation of the traffic regulations or any Romanian law; to transport passengers or goods for remuneration; to push or tow any car, trailer or any other object; under the influence of alcohol, drugs or any other substances which may influence the driving abilities, affecting the concentration or the capacities to drive; in races, contests or tests; on roads unmarked on the Romanian country map; used by any unauthorized person (any other person than those specified in this agreement).
The customer also agrees: not to keep the car unlocked when not using it or to leave the car documentation inside the car; not to allow the overloading of the car with respect to the number of places or weight over the maximum limits which are mentioned on the registration card. Regardless of the type of insurance chosen (or not), the customer is responsible for the whole amount of damages brought to the car, property of Bavaria Rent | BMW car rental/hire, in any of the cases stated above. In case of accident, the customer has the obligation to notify both Bavaria Rent | BMW car rental/hire and the nearest police station.
The customer understands that one must provide Bavaria Rent | BMW car rental/hire the following documents:
(A) The police report of the accident signed and stamped or Annex no. 2 representing the form to be filled for the Insurance Company;
(B) The repair authorization issued by the police, signed and stamped. Insurance is only valid if the customer obtains the documents stated above; otherwise, he will be held liable for the whole amount of the damages and authorizes Bavaria Rent | BMW car rental/hire to proceed to all necessary steps in order to recover the whole amount of the damages. The customer has the obligation to keep all documentation related to the car rental/hire for a period of minimum 90 days. The customer shall not assign, sell, mortgage or pledge the present agreement, the car, its equipments or tools or to cause any other action detrimental to Bavaria Rent | BMW car rental/hire. Any of these mentioned above empowers Bavaria Rent | BMW car rental/hire to demand return of the car forthwith.

Article 5 Age restrictions:
Minimum age for EDMR and IDMR categories is 21 and a valid driver's license for at least one year; minimum age for SDMR and FFMR category is 23 and a valid driver's license for at least 3 years; minimum age for PDAR, PFAR categories is 25 and a valid driver's license for at least 3 years; any additional driver must comply with these age restrictions.

Article 6 Reservations:
Reservations can be confirmed only for car groups, not for each car type.

Article 7 Conditions of Payment:
Bavaria Rent | BMW car rental/hire  accepts all major international Credit Cards - such as American Express, Diners Club, Eurocard - MasterCard and Visa - are accepted. All cash payments are in RON and accepted only in combination with a valid credit card, for security reasons. In case of payment order, the customer compels to pay in term of 5 days starting with the date the invoice is issued.
Should the customer fail to compel his payment obligation mentioned above, he understands and agrees that he owes to Bavaria Rent | BMW car rental/hire due payment in value of 0.2%/day payment. The due payment can exceed the total amount to which it is applied.
In addition to the basic car rental/hire price stipulated by the present agreement, the customer agrees and undertakes to pay the following: All the amounts regarding the repairs of the damages caused to the car, property of Bavaria Rent | BMW car rental/hire. These amounts refer, as an example, to the damages resulting from improper use of the car, damages resulting from inappropriate maintenance of the car, damages resulting from cutting, stinging or explosion of the envelopes or tires. Traffic or parking fines, parking tickets, costs and taxes for any violation of traffic regulations. The customer agrees upon signing this agreement that he will be charged with any amount necessary in order to cover such costs as mentioned above. Bavaria Rent | BMW car rental/hire will prove the existence of such costs by official documentation.
By signing this car rental/hire agreement, the customer consents to his credit card being debited with any of the amounts mentioned above, regardless of the fact he is or not to be present at this operation.

Article 8 Car Rental fees:
Oil, maintenance and third party liability are included in the car rental/hire price. Fuel is not included. The car will be delivered with a full fuel tank to the customer, who, in turn, has to return the car, property of Bavaria Rent | BMW car rental/hire with a full tank. For missing fuel, there is a tax of 2 Euro/liter (VAT excl). These surcharges are subject to change without prior notice by Bavaria Rent | BMW car rental/hire. Minimum rental period is 1 day (24 hours). For monthly or long term rentals, information is available on request, and in case of prolongation of the rental period, the customer is asked to show himself at the cashier in order to allow being charged for the amount corresponding to the extension, either on the credit card or in cash.

Article 9 Additional costs:
The customer agrees to be responsible and charged for any of the following costs: an additional fee applies to rentals taking place on an airport location, for each rental; minimum rental period is 1 day (24 hours). The first hour of delay over the time of return specified in the agreement is free. Should the delay of the car, property of Bavaria Rent | BMW car rental/hire, be more than 1 hour, there will be a surcharge of one additional renting day, according to the pricelist; an additional driver surcharge of 20 Euro is applied, for each additional driver and for each rental; depending on each rate, there will be a surcharge for extra mileage; in case of loss or damage of the car, property of Bavaria Rent | BMW car rental/hire, documentation or car keys, a surcharge of 100 Euro applies.
In case of loss or damage to the airport parking ticket, a surcharge of 150 Euro applies. These amounts will be debited from the customer's credit card; should the condition of the car be extremely unhygienic at the return, a surcharge of 20 Euro applies; the rate for delivery and collection in town is 20 Euro and for any other locations in or outside the city limits, other surcharges will be applied; for special equipments for the car, additional taxes shall be charged; baby seats and snow chains are available on request, for an additional fee of 20 Euro (VAT excl.), for each rental. By signing this agreement, the customer consents to his credit card being debited with any of the additional costs mentioned above. In this respect, the customer compels to sign any document required by Bavaria Rent | BMW car rental/hire with regard to the additional costs.

Article 10 Warranty:
At the request, the customer will constitute a warranty for guaranteeing the non-waivable responsibility (NWR). For guaranteeing the payment obligations, the customer will block in his bank account the equivalent of the rent and the warranty mentioned above. Bavaria Rent | BMW car rental/hire shall not refund the warranty to the customer up to the non-waivable responsibility (NWR), in case of theft or embezzlement (even if there is a valid police report), in case of lack of car accessories or in any of situations mentioned at art. 7. For collecting any claim regarding the customer's failure to compel the payment obligations, Bavaria Rent | BMW car rental/hire is authorized by the customer to debit his credit card bank account up to the amount of the blocked sum containing the rental payment and the warranty. In this respect, the customer compels to sign any document required by Bavaria Rent | BMW car rental/hire. In case the customer fails to compel his payment obligations in a term of 30 days at the latest from returning the car, additional penalties will be applied according to art. 7. In case the customer, for any reason, fails to compel his payment obligations or refuses to sign any document with regard to Bavaria Rent | BMW car rental/hire efforts to collect this amount, the customer agrees that Bavaria Rent | BMW car rental/hire might institute proceedings against him and obtain a judgment which represents, according to the Romanian applicable law, an enforceable title.

Article 11 General terms of insurance:
Insurance includes third party liability for all Bavaria Rent | BMW car rental/hire cars. This covers an amount of maximum 300.000 RON for cars other than Bavaria Rent | BMW car rental/hire cars involved in an accident and an amount of maximum 100.000 RON for each person, with a total of maximum 500.000 RON for all persons involved in an accident. Should the amount of the damages from an accident exceed any of the above-mentioned values, the customer is entirely responsible for covering these costs and authorizes Bavaria Rent | BMW car rental/hire to take all necessary measures in order to recover all costs. The insurance does not cover situations in which the car is used to transport flammable or other dangerous substances or materials. The customer understands that he is responsible for the payment of the non-waivable responsibility (NWR), which is not covered by the insurance company. The non-waivable responsibility (NWR) is considered to be a loss recovery for Bavaria Rent | BMW car rental/hire, since the car is unavailable for its use according to the purposes of Bavaria Rent | BMW car rental/hire (car rental activity). The customer is offered the possibility to accept a collision damage waiver (CDW) and/or a loss damage waiver (LDW), with values as specified in the following chart. The collision damage waiver does not include theft protection (TP). LDW includes both CDW and TP. CDW and LDW are only valid on Romanian territory. The following amounts are in Euro and 19% VAT exclusive. If CDW and TP is not accepted the customer will be held liable for the value of the damages. PAI is not available. It can be available on request as negotiated with the insurance company. Separate regulations may apply for special agreements with certain customers. Damages to wheels, tires, mirrors, windows, the exterior floor or the interior of the car are not covered by CDW/LDW and should any of these damages appear, the customer agrees to replace them or to be charged for their value, hereby authorizing Bavaria Rent | BMW car rental/hire to debit his credit card with the necessary amount, deductible from the warranty.
In case of returning the car during out of program hours, the customer agrees to pay the eventual damages observed on the car by Bavaria Rent | BMW car rental/hire personnel, which is obliged to announce the customer of them within 24 hours. Bavaria Rent | BMW car rental/hire is obliged to justify these expenses by official documents (technical certificate, service invoice, police report etc.). CDW and LDW do not exclude the customer from being charged for damages to the car, which may appear under the following circumstances, or under any of the circumstances mentioned in art. 4: willful deterioration of the car or deterioration by gross negligence; a police report has not been obtained by the end of the rental period; the rented car is driven by an unauthorized person (any person who is not stated on the rental agreement as a driver/additional driver); in case of the customer providing Bavaria Rent | BMW car rental/hire with fake data regarding his identity, address or validity of his driver's license; in this case, the customer is not covered by the insurance policy. Bavaria Rent | BMW car rental/hire declines any responsibility for objects left in car, during the rental period, any responsibility for accidents, which the customer may have caused and for which he alone shall be responsible. The customer understands that should he loose the keys of the car or the car documentation, he then shall be responsible to pay to Bavaria Rent | BMW car rental/hire the amount of money representing the value of the car at the moment he lost the keys of the car or the car documentation. This value is stipulated in the agreement concluded by Bavaria Rent | BMW car rental/hire with its insurance company. In case of holding back an accident or repairing the car without the permission of Bavaria Rent | BMW car rental/hire, the client will be charged for the entire amount of the repairs, and the insurance is no longer valid.

Article 12 Border crossing:

Article 14 Taxes:
19% VAT is applicable to the price list.

Article 15 Applicable Law/Jurisdiction:
This car rental agreement shall be considered as entered into force under and governed by Romanian law. Any dispute, controversy or claim arising out of or in connection with this agreement, or any breach, termination or invalidity therefore shall, at the request of any of the Parties, be finally settled by Bucharest sector 6 Court-of-law.
